Tobacco Use by Persons under 21 Years of Age and Sale and Distribution of Tobacco Products Act: Penalties

(h) All moneys collected as fines for violations of subsection (a), (a-5), (a-5.1), (a-6), (a-8), (b), or (d) or (a-7) of Section 1 shall be distributed in the following manner:
(1) one-half of each fine shall be distributed to the unit of local government or other entity that successfully prosecuted the offender; and
(2) one-half shall be remitted to the State to be used for enforcing this Act.

Possession of drug paraphernalia

(c) If a person violates subsection (a) of Section 4 of the Cannabis Control Act [720 ILCS 550/4], the penalty for possession of any drug paraphernalia seized during the violation for that offense shall be a civil law violation punishable by a minimum fine of $100 and a maximum fine of $200. The proceeds of the fine shall be payable to the clerk of the circuit court. Within 30 days after the deposit of the fine, the clerk shall distribute the proceeds of the fine as follows:

(f) Notwithstanding Section 1463, the fines paid pursuant to this section shall be apportioned as follows:
(1) Fifty percent shall be deposited in the Environmental Enforcement and Training Account established pursuant to Section 14303, and used for purposes of Title 13 (commencing with Section 14300) of Part 4.
(2) Twenty-five percent shall be distributed pursuant to Section 1463.001.

Fee for specialty court programs

6.  The money collected for a specialty courts fee pursuant to this section in municipal court must be paid by the clerk of the court to the city treasurer on or before the fifth day of each month for the preceding month. On or before the 15th day of that month, the city treasurer shall deposit the money received for each specialty courts fee with the State Controller for credit to a special account in the State General Fund administered by the Office of Court Administrator.

(b) Once debt becomes delinquent, it continues to be delinquent and may be subject to collection by a comprehensive collection program . . . .

(d) Nothing in this section shall be construed to prohibit the clerk of the court, or the judge if there is no clerk, from turning these accounts over to another county department or a collecting agency for processing and collection.(e) The defendant shall pay to the clerk of the court or the collecting agency a fee for the processing of installment accounts. This fee shall equal the administrative and clerical costs, as determined by the board of supervisors, or by the court, depending on which entity administers the account.
